JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-07-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioners as well as the learned counsel for the informant and Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Ladaniya P.S. Case No. 54/2021 registered for offence punishable under sections 341, 323, 324, 448, 307, 504, 506/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.66445 of 2021(2) dt.25-07-2022 2/3 As per allegation, the son of the informant was playing in the field after parking his motor cycle. Petitioner no.2, without permission from the son of informant, took away his motor cycle and returned after some time. The son of the informant asked as to why had he taken the motor cycle without his permission. There was some quarrel between them. In the evening, petitioner no. 2 came to the house of the informant with his brother, petitioner no. 1. Petitioner no. 1 caught hold the hands of the informant's son and petitioner no. 2, Subham Kumar inflicted knife blow in his stomach and made him badly injured.

The learned counsel for the petitioners has submitted that the petitioners are innocent and the occurrence took place on some trivial issues.

The learned counsel for the informant has opposed the prayer for bail and submitted that there is a specific allegation on petitioner no. 1 that he caught hold the son of the informant and petitioner no. 2 inflicted deadly knife blow in his stomach and made him badly injured. The injuries are grievous in nature.

Considering the above-mentioned facts and circumstances, the petitioners do not deserve the privileges for

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
