ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 6.7.2014 in Sadar P.S. Case No.319/14 for the offence under Section 393 of I.P.C. Earlier the petitioner was taken into custody on 27.6.2014 in connection with Purnia Sadar P.S.Case No.320/14 in connection with Arms Act.

It is submitted on behalf of the petitioner that in connection with Purnia Sadar P.S. Case No.320/14 he has already been extended the privilege of bail in Cr.Misc.No.39929/14 vide order dated 22.10.2014. Learned counsel for the petitioner submits that actually Purnia Sadar P.S.Case No.319/14 was registered prior to Purnia Sadar P.S. Case No.320/14 for one and the same

Patna High Court Cr.Misc. No.46296 of 2014 (2) dt.16-02-2015 2/2 offence and there is discrepancies in these two F.I.Rs which casts cloud on the prosecution story.

Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 6.7.2014, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Purnia, in Sadar P.S.
