JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.11.2015 on the accusation that he along with some other F.I.R. named accused persons assaulted the deceased by means of lethal weapons. Admittedly, omnibus allegation of assault has been levelled against the petitioner and having more or less similar allegation, co-accused Shatrughan Singh and Prakash Singh have already been granted privilege of bail by co-ordinate Benches of this Court. The impugned order reveals that altogether four injuries were found on the person of the deceased whereas allegation of assault has been levelled against eight accused persons including

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Bhagalpur in connection with Shahkund (Sajour) P.S.
