The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 40.2 litres Nepali wine was recovered from a sack which was thrown by the pillion driver. Petitioner claims that he is having clean antecedent and is in custody since 10.09.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.53186 of 2017(2) dt.09-11-2017 2/2 satisfaction of the Addl. Sessions Judge VII-cum-Special Judge, Excise, East Champaran, Motihaari in connection with Ghorasahan (Lakhaura) P. S. Case No. 456 of 2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
