This application for grant of regular bail arises out of Sessions Trial No. 70 of 2013 (arising out of Bettiah (Muffasil) P.S. Case No. 210 of 2012, disclosing offences under Section 304B of the Indian Penal Code.
By an order dated 10.04.2015 passed in Criminal Miscellaneous No. 8262 of 2015, the application for regular bail filed by the petitioner was rejected with a liberty to renew his prayer for bail after six months, if in the meanwhile, the trial was not concluded. It was noted in the said order that by that day two prosecution witnesses out of fourteen had already been examined.
Patna High Court Cr.Misc. No.4411 of 2016 (2) dt.04-05-2016 2/2 Learned counsel for the petitioner submits that the status of the trial is almost the same as it was, on that date and there is no substantial progress in the trial. It has further been submitted that petitioner is in custody since 26.05.2012. Considering the facts and circumstances, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Vth Additional District and Sessions Judge, Bettiah, West Champaran in connection with Sessions Trial No. 70 of 2013 (arising out of Bettiah (Muffasil) P.S. Case No. 210 of 2012. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
