JUSTICE BIRENDRA KUMAR ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 120B read with Sections 419, 420, 464, 468 and 471 of the Indian Penal Code.

Some other candidate appeared in the examination for the petitioner.

Submission of the learned counsel for the petitioner is that cheating by impersonation is bailable and other offences are not made out against the petitioner.

Learned counsel for the C.B.I. opposed the prayer for anticipatory bail on the ground that there is allegation of tampering the admit card by pasting photograph of unreal

Patna High Court Cr.Misc. No.53864 of 2018 (3) dt.11-10-2018 2/2 person, just to get wrongful benefit and for that reason offences under Sections 464, 468 and 471 are also alleged. It appears that co-accused Rajaneesh Kumar Verma @ Ragneesh Kumar has already been allowed anticipatory bail by this Court vide order dated 04.10.2018 passed in Cr. Misc. No. 61079 of 2018. Allegation against the petitioner is on similar footing.

Hence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Spl. Case No. 4(E) 2011 on the basis of R.C. 219 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
