Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201/ 34 of the Indian Penal Code.

It is alleged that on refusal to give extortion the petitioner and one Kundan Rai assaulted the husband of the informant with knife and subsequently threw the dead body in a well.

It is submitted by learned counsel for the petitioner that from the perusal of the F.I.R, it appears that informant is not an eye witness to the occurrence. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation, this
