The petitioners seek bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

85 liters & 800 ml. of Nepali Saufi wine has been recovered from two bags, which are alleged to have thrown by these petitioners.

It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. The alleged bags do not belong to these petitioners. Petitioners are in custody since 04.09.2021. Investigation is complete.

Patna High Court CR. MISC. No.66414 of 2021(2) dt.21-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge (Excise), Sitamarhi in connection with Sursand P.S. Case No. 414 of 2021.
