The petitioner seeks bail in Majhaulia P.S. Case No. 331 of 2017 registered for the offence punishable under Sections 304(B), 302/34 of the Indian Penal Code.
Informant is the mother of the deceased, who in her fardbeyan had stated that the marriage of her daughter was solemnized with the son of the petitioner in the year 2015, but her daughter was being subjected to torture for non fulfillment of demand of dowry and on 29.08.2017, she learnt that her daughter and her four months old grand-daughter died in a fire accident. Her in-laws are responsible for her killing and she was killed by setting her ablaze by fire. When she reached the matrimonial house of her daughter, she found her daughter
Patna High Court Cr.Misc. No.60908 of 2017(3) dt.16-01-2018 2/2 completely burnt and lying dead.
The petitioner is the Father-in-Law of the deceased and it has been stated that he is living separately and has no concern with the day to day affairs of his family. An affidavit has been sworn on behalf of the informant that on account of apprehension she had lodged the FIR. Petitioner is in custody since 03.10.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S.
