This application for anticipatory bail arises out of Saharsa Sadar P.S. Case N0. 419 of 2019, disclosing offences under Sections 25 (1-b),26,35 of the Arms Act. Considering the fact that the petitioner has criminal antecedent of being an accused in a case registered in 2018 for the offences punishable under Sections 399,402 of the Indian Penal Code and Sections 25( 1-B) a, 26,35 of the Arms Act, I am not inclined to grant the petitioner privilege of anticipatory bail.

Learned counsel appearing on behalf of the petitioner has attempted to convince this Court that he has been implicated because he is brother of Hunny Chaudhary, who is main accused and, therefore, he has been implicated.

Patna High Court CR. MISC. No.54668 of 2019(4) dt.20-11-2019 2/2 I am not inclined to consider the said submission for the purpose of grant of anticipatory bail because of the petitioner's involvement in another case, as has been indicated above.

This application is, accordingly, dismissed.

The petitioner is directed to surrender before the Court below within four weeks from today, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present anticipatory bail by this Court.
