ANJANA MISHRA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners being the husband and the mother-inlaw of the deceased are apprehending their arrest in connection with Raghunathpur P.S. Case No.41 of 2015 for the offence under Sections 302/201/34 of the I.P.C.
The case diary in the present case which was called for has now since been received.
It appears that the marriage took place in the year 1998 itself and there is no allegation regarding demand of dowry. It is submitted on behalf of the petitioner that actually the petitioner no.1 resides at Gujrat whereas petitioner no.2 is residing in Siwan. He further submits that it has come in the case diary that
Patna High Court Cr.Misc. No.4649 of 2016 (4) dt.15-07-2016 2/2 the deceased lady had died of snake bite. Further more the call details of the petitioner reveal that the maternal family members of the deceased had been contacted but they did not come when the deceased was cremated.
Considering the aforementioned facts and circumstances, and there is no cogent material to implicate the petitioners in the present case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sri D.N. Bhardwaj, J.M.1st Class,Siwan, in Raghunathpur P.S. Case No.41 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
