JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioners, learned counsel appearing on behalf of the informant and learned Assistant Public Prosecutor for the State.
This application for grant of anticipatory bail arises out of Andar (M.H. Nagar, Hasanpura) P.S. Case No. 08 of 2015, disclosing offences under Sections 394 and
Patna High Court Cr.Misc. No.32049 of 2015 (2) dt.12-08-2015 2/2 302/34 of the Indian Penal Code.
Considering the fact that the petitioners are accused under Section 302 of the Indian Penal Code and their custodial investigation may be required by the police, I am not inclined to grant the petitioners the privilege of anticipatory bail.
This application is, accordingly, rejected.
The petitioners, abovenamed, are directed to surrender before the court below within six weeks and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
