JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, I find that name of petitioner came in supervision note of Dy.S.P. and after that some witnesses stated about the involvement of the petitioner in the alleged crime.
Learned counsel for the petitioner submits that except criminal antecedent of the petitioner as well as suspicion, there is nothing against him and moreover, petitioner has been dragged in this case by the police and that is the reason prior to statement of witnesses, the Dy.S.P. named the petitioner in his supervision note.
Patna High Court Cr.Misc. No.4638 of 2016 (2) dt.11-02-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Sitamarhi in connection with Sessions Trial No. 31 of 2015 arising out of Bathnaha P.S. Case No. 138 of 2012.
