JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2018 Heard learned counsel for the appellant and learned Special P.P. for the State.

This petition for bail was earlier rejected by this Court by order dated 29.06.2017 passed in Cr. Appeal (SJ) No. 783 of 2017 as Annexure-1 with direction to the learned Court below to expedite the trial and conclude the same within a period of four months.

Submission of the learned counsel for the appellant is that period of four months has already expired and the trial has not been concluded as yet and after examination of all charge sheet witnesses, the prosecution has filed an application to call for Sonu Kumar, who is not charge sheet witness in the present case. Heard learned Special P.P. also.

In view of the facts as stated above, I am not

Patna High Court CR. APP (SJ) No.3440 of 2017 (5) dt.07-02-2018 2/2 inclined to grant privilege of bail to the appellant. However, learned Trial court is directed to expedite the trial and try to conclude the same within further period of two months. If no laches is found on the part of the appellant, the learned Court below shall release the appellant to his own satisfaction and the appellant shall co-operate in the disposal of the trial and make himself available as and when required by the Court below. With the above observation, this appeal is disposed of.
