JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 376/511, 380, 427 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner entered into the house of the informant and made attempt to ravish her and when the fatherin-law and mother-in-law came to rescue, they were also assaulted. The accused persons and also took away a bag containing `20,000/-. It is further alleged that subsequently the informant along with her parents-in-law went to the house of the petitioner to make complain but the family members of this petitioner abused, assaulted and destroyed the house hold articles of the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.32225 of 2015 (2) dt.12-08-2015 2/2 for the occurrence of 17.04.2015, the FIR was registered on 04.05.2015 and prior to lodging of the present case, wife of the petitioner lodged Bochahan P.S. Case No. 49 of 2015 with accusation punishable under Sections 341, 323, 447, 379, 504 and 506/34 of the IPC and Section 3/4 of The Prevention of Witch (Daain) Practices Act against the father-in-law and other family members of the informant on 07.04.2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the case lodged by petitioner's side at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Muzaffarpur in connection with Bochaha P.S. Case No. 67 of 2015 , subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
