Petitioner seeks bail in a case registered under Sections 406, 420/34 of Indian Penal Code.

It is submitted by learned Senior Counsel for the petitioner that President of the Primary Agricultural Credit Society (for brevity PACS), who is said to be the main accused in the instant case, has already been allowed bail by this Court under order dated 12.07.2019 passed in Cr Misc No 43093 of 2019. Others co-accused persons have also been granted bail under other orders. The petitioner is Assistant Cashier and had no pivotal and responsible role in the alleged misappropriation of the deposits of farmers in the PACS. Petitioner is in custody since 15.07.2019 and is a man of clean antecedent as per

Learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, prayer for bail is allowed.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Aurangabad in Fesar Police Station Case No 48 of 2018 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailors will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
