The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code.

As per the prosecution case, petitioners along with coaccused persons prepared some forged documents to commit fraud and instituted false suit before the court below against this informant and her son.

Informant is owner of shop and petitioners are sons of renter Om Prakash Rao. Due to tenancy dispute between the parties, this false case has been lodged. A civil suit no. 40 of 2021/684 of 2021 is already pending between the parties. Counsel for informant however vehemently opposed

Patna High Court CR. MISC. No.55600 of 2022(2) dt.13-12-2022 2/2 the prayer for bail.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gaya in connection with Civil Line P.S. Case No. 280 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
