JUSTICE BIRENDRA KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Katoria P.S. Case No. 93 of 2017, a case under Section 394 of the Indian Penal Code and Sections 3, 4 and 5 of the Explosive Substance Act. The F.I.R. of the occurrence of robbery is against unknown. Submission is that similarly situated co-accused Ramesh Yadav and Mithilesh Pandit have already been allowed bail by different co-ordinate Benches of this Court in Criminal Miscellaneous No. 58836 of 2017 and in Criminal Miscellaneous No. 46434 of 2017 respectively.

Considering the aforesaid fact, let the petitioner, above

Patna High Court Cr.Misc. No.59307 of 2017 (3) dt.10-01-2018 2/2 named, be also released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Katoria Police Station Case No. 93 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
