2. The learned counsel for the petitioners submits that under order dated 26.07.2024, petitioner nos. 1 and 2 were granted bail.
3. He submitted further that in the impugned order, it was mentioned that petitioner no.1 has a criminal antecedent. Assuming it to be true, the learned counsel for the petitioner had submitted that petitioner no.1 has criminal antecedent and considering this fact, despite being granted bail, he was directed
Patna High Court CR. MISC. No.61843 of 2024(3) dt.06-09-2024 2/2 to furnish his bail bond after four months. Learned counsel submits that, as a matter of fact, petitioner no.1 is a person of clean antecedent and due to mistake on the record (in the impugned order) an antecedent of one case has been mentioned.
4. Considering the above facts and circumstances, the order dated 26.07.2024 passed in Cr.Misc. No. 50897 of 2024 is modified and the petitioner Vishal Prasad Yadav @ Vishal Kumar shall be released on bail on furnishing bail bond Rs. 10,000/(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S.Case No. 39 of 2024 with the condition that he will cooperate in the disposal of the trial and make themselves available as and when required by the court.
