JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 This application, for grant of anticipatory bail, arises out of Muffasil P.S. Case No. 182 of 1998, disclosing offences under Sections 147, 148, 149, 353, 307, 337, 338, 224, 225, 427, 332, 333 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the F.I.R. and there is allegation that he along with several others pelted stones on the police party causing injuries to them. It further appears that the case is of the year 1998.

Submission of learned counsel for the petitioner is that the investigation is still continuing against the petitioner and no steps either summon or warrant has ever been issued against the petitioner. Further submission is that no specific allegation has been attributed to him.

Having heard both sides, let petitioner surrender in the court below within a period of two weeks from the date of receipt of a copy of this order in the court below and the learned court below shall verify the submission as to whether any warrant of arrest or any other process has been issued against the petitioner and if it is not, the court below shall release the petitioner on bail to his own satisfaction otherwise, petitioner will have to surrender in the court below and pray for regular bail.
