The petitioner apprehends his arrest in connection with Kumarkhand P.S. Case No.216 of 2019 registered under Section 366A read with section 34 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim girl has given her statement under Section 164 of the Cr.P.C. in which the Court has assessed the victim as major. The victim has stated that she has got marriage with the petitioner with her sweet will and is living with her husband as is evident from Annexure 2. The petitioner has got no criminal antecedent.

No.60370 of 2022(3) dt.23-01-2023 2/2 Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Sessions Judge VI-cumSpecial Judge, POCSO, Madhepura in connection with Kumarkhand P.S. Case No.216 of 2019, POCSO 57 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
