The petitioner apprehends his arrest in Barachatti P.S. Case No. 74 of 2015, registered for the offences punishable under Sections 366A/34 and 376 of the Indian Penal Code. The petitioner is not named in the FIR. The father of the victim made allegation that Mantu Kumar and others kidnapped his minor daughter. The victim appeared and made her statement under Section 164 of the Cr.P.C.
It is alleged that Mantu Kumar and Manish Kumar kidnapped her. She further alleged that Mantu Kumar committed rape with her. The petitioner brought her to the Police Station. The victim did not make any allegation against the petitioner. The
Patna High Court Cr.Misc. No.27326 of 2015 (2) dt.21-07-2015 2/2 petitioner happens to be cousin of Mantu Kumar who brought her to the Police Station. Other co-accused Sona Devi and Rupan Yadav have already been enlarged on anticipatory bail. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 74/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
