JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Ara Town P.S. Case No. 164/2015 for the offences instituted under Sections 302, 120(B) of the IPC and 27of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.
It is alleged that the petitioner alongwith other coaccused persons murdered the elder brother of the informant due to some land dispute.
It has been submitted on behalf of the petitioner that the name of the petitioner has appeared in the present case merely on the basis of suspicion that there is a family dispute in respect to the property. It is further submitted that there is no direct or indirect
Patna High Court Cr.Misc. No.27374 of 2015 (2) dt.22-07-2015 2/2 evidence against the petitioner for committing murder of the deceased. It is further submitted that the petitioner has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Ara Town P.S. Case No. 164 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
