Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 17.2.2017 passed in Cr. Misc. No.6978 of 2017, with a direction to the learned court below to expedite the trial and conclude it within a period of nine months.
Submission of the learned counsel for the petitioner is that nine months' period has already expired but no substantial progress has been made in this case and only the charge has been framed. The aforesaid fact also appears from the report submitted by the learned trial court.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be
Patna High Court Cr.Misc. No.60566 of 2017 (4) dt.17-01-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Nayan Kumar, J.M. Ist class, Muzaffarpur in connection with Kudhani 380 of 2016 corresponding to T.R.No.1814 of 2017 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
