JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Pipra PS Case No. 108 of 2017 registered under Sections 363 and 365 of the IPC.

Learned Counsel for the petitioner submits that there is nothing against the petitioner except disclosure of his name by three co-accused, in fact he has falsely been implicated due to inimical terms as he is son-in-law of cousin of the informant and his case is on different footing to Ram Kumar Kamar, whose bail was rejected by a coordinate Bench of this Court. This petitioner has no criminal antecedent and is in custody since 28.6.2017/ Having considered the said facts and circumstances, the petitioner, namely, Pawan Mishra @ Pawan Kumar Mishra @ Pawan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM III Supaul in connection with Pipra PS Case No. 108 of 2017.
