18-06-2015 Heard learned counsel for the petitioner and Sri Shyam Bihari Singh, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Industrial P.S. Case no.28 of 2014 ( G.R. No.1578 of 2014) registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner at the very outset submits that in this case, other two accused have already been extended the privilege of anticipatory bail by this Court vide Cr.Misc.No. 39224 of 2014 which fact was noticed by the learned Sessions Judge, while hearing anticipatory bail petition of this petitioner. He further submits that the present case has falsely been
Patna High Court Cr.Misc. No.20641 of 2015 (2) dt.18-06-2015 2/2 instituted. He submits that prior to lodging of the present case as per information given by husband of sister's wife ( Sarhu), earlier an F.I.R. was lodged vide Industrial P.S. Case No.21 of 2014 on 27.04.2014 for the offence under Sections 341, 323, 504, 506, 34 of the Indian Penal Code. Subsequently the present case was lodged, in which accusation was made regarding assault. However, injuries were found to be simple in nature. In view of facts and circumstances, the Court considers that it is a fit case for extending the privilege of anticipatory bail. Let the petitioner, namely, Sanjay Yadav @ Sanjay Kumar Yadav in the event of his arrest or surrender within a period of one month from today, be released on bail on furnishing bail bond of Rs.
10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Industrial P.S. Case No.28 of 2014, subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
