The petitioner apprehends his arrest in connection with Malsalami P.S. Case No. 434 of 2021 registered under Section 30(A) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty local politics. A supplementary affidavit has been filed stating therein that the vehicle where from the alleged recovery in question has been made does not belong to the petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below

No.55343 of 2022(4) dt.09-01-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the Special Judge Excise, Patna City, Patna in connection with Malsalami P.S. Case No. 434 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
