====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 10-09-2024 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Basmatiya P.S. Case No. 01 of 2024 dated 07.04.2024 registered for the offences punishable u/ss 21(b), 22, 23 of the N.D.P.S. Act.

3. As per the prosecution case, on 07.04.2024 at about 2:45 O'clock, the informant got a secret information that one Krishna Kumar Yadav has kept narcotic drug/psychotropic substance at his house. On information, he along with the team raided the house of the petitioner, on seeing the police, the petitioner fled away from the house and on search, the police recovered drug like substances, Nitrazepam tablets IP 10 mg, Nitravet 10 (10 mg) total 150 tablets and Spasmo Proxyvon Plus (Tramadol Hydrocloride) total 552 each containing 50 mg

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one criminal antecedent of similar nature as stated in para 3 of the bail petition. The petitioner is in custody since 31.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the recovery has been made from the house of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Araria in connection with Basmatiya P.S. Case No. 01 of 2024.

7. The application stands allowed.
