The petitioner, already in custody, seeks bail in connection with Nathnagar P.S.Case No. 743 of 2017 registered under Sections 302 and 120B of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that informant's husband was killed by the FIR named accused persons on account of land dispute. Submission is that petitioner is not named in the FIR and there is no land dispute with the petitioner and only on the basis of statement of one Lalita Devi, who is also witness to the FIR, disclosing the name of the petitioner has been implicated in this case, had it been so, she could have disclosed this fact at the time of institution of the FIR by the informant; moreover, petitioner has also no criminal antecedent.

No.15175 of 2018(6) dt.05-07-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely , Pugeshwar Mandal @ Puggi is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Bhagalpur in connection with Nathnagar P.S. Case No. 743 of 2017.
