JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is apprehending his arrest in connection with Sultanganj P.S. Case No. 143 of 2012 for the offences instituted under Sections 420, 467, 468, 379, 203, 424 and 411/34 of the IPC.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that when the police found a Bolero vehicle in front of the door of one Ram Kishore Singh and made query thereabout then it was found that the said vehicle was got parked there by accused Shashank Shashi. Later on, when the co-accused Shashank Shashi was asked to show the papers and also the authority to park the vehicle in front of the house, then he told about name of this petitioner and ensured the police to produce the said man with paper. It is then alleged that

No.29590 of 2015 (2) dt.28-07-2015 2/2 the police, thereafter handed over the possession of the said vehicle to the accused Ram Kishore Singh but in the night of the date of occurrence, the vehicle was removed from there and taken to some another place instead of producing the alleged original owner with paper.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner's name has appeared in the present case on the basis of confessional statement of the co-accused. The said coaccused has been granted bail vide Cr. Misc. No. 5733 of 2013. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sultanganj P.S. Case No. 143 of 2012 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
