ANJANA PRAKASH ORAL JUDGMENT Date: 08-10-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks revision of the Judgment of conviction in Appeal dated 17.9.2014 passed by the 3rd Additional Sessions Judge, Jehanabad, in Criminal Appeal No. 30 of 2012/12 of 2014 by which he has affirmed the Judgment of conviction and order of sentence dated 1.8.2013 passed by the Judicial Magistrate, 1st Class, Jehanabad, in Trial No. 3006 of 2013 arising out of Ghoshi P.S. Case No. 232 of 2007, appertaining to G.R. No. 2059 of 2007. On the last occasion, this Court had granted six months Provisional bail to the Petitioner in order to enable him to deposit the entire arrears of maintenance amount decreed by the Court below. A supplementary affidavit has been filed stating therein

Patna High Court CR. REV. No.977 of 2014 dt.08-10-2015 2/2 that he has done so which fact is not disputed by the counsel for the Complainant.

Having gone through the impugned Judgment, I find no reason for interfering with the conviction of the Petitioner. Hence, the revision application is dismissed. However, considering the subsequent conduct of the Petitioner, the sentence is reduced to one already undergone by him. Also the Petitioner shall regularly deposit the maintenance amount till such time as it is revised.
