JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364A,365 and 366 of the Indian Penal Code.
The accusation is of kidnapping the wife of the informant.
It is submitted by the learned counsel for the petitioner that on 26.1.2014 the wife of the informant went traceless but the complaint was filed on 3.6.2014 which came to be registered as police case on 16.10.2014. More over, the mother of the informant was made accused in Kankarbagh P.S. Case No. 35 of 2014 registered under sections 3,5,6 and 7 of Immoral Traffic (Prevention) Act when it was suspected that petitioner got her arrested. The informant married with the victim Neha
Patna High Court Cr.Misc. No.29327 of 2015 (2) dt.27-07-2015 2/2 who was already married. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case, particularly, lodging the complaint after six months of the victim went traceless, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Ramkrishna Nagar P.S. Case No. 204 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
