2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 111(4) of the B.N.S. and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. The case of the prosecution is that one Pappu Kumar identified this petitioner while the police was raiding the miscreants and it is further alleged that from the possession of this petitioner, one country made pistol and one mobile were recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that there is no independent witness and

Patna High Court CR. MISC. No.58361 of 2025(2) dt.27-08-2025 2/2 even the seizure list does not contain the signature of the petitioner. Only one country made pistol is recovered. Moreover, the petitioner is languishing in judicial custody since 23.05.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lauriya P.S. Case No. 216 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st , Bettiah, West Champaran.
