Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B) 26, 35 of the Arms Act and Section 4/5 of the Explosive Substances Act.

It is alleged that informant being SHO, Mehandia P.S reached to the house of the informant to investigate Mehandia P.S. Case No. 32 of 2014 when the petitioner escaped from the scene after dropping a bag which contained grenade. From the house of petitioner one double barrel gun and 33 live cartridges were recovered. It is submitted by learned counsel for the petitioner that petitioner is a retired army personnel and the gun is licensee one when recovery of grenade can not be treated

Patna High Court Cr.Misc. No.34786 of 2015 (2) dt.17-08-2015 2/2 to be from the possession of the petitioner.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Mehandia P.S. Case No. 33 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Jehanabad. Accordingly the application is disposed of.
