Petitioner seeks regular bail in connection with Bettiah Mufassil ( Banuchhapar O.P.) PS Case No. 721 / 2020 registered for the offence under Section 394 of the IPC. Four persons allegedly intercepted the informant and snatched mobile and a sum of Rs. 25000/- from the pocket of the informant on the point of gun and knife. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and he has not committed any offence as alleged. Learned counsel further submits that petitioner is not named in the FIR and the FIR is against unknown. He also submits that no incriminating and / or looted article has been recovered from possession of the petitioner and he has not been put on Test Identification Parade.

Accordingly submission is that petitioner has falsely been implicated in this case merely because four cases are pending against him.

Regard being had to the submissions made by the parties, taking into consideration the material available on record, the fact that petitioner is in custody since 12/02/2021 , charge sheet has already been submitted, no incriminating and / or looted article has been recovered from the possession of the petitioner and he has not been put on Test Identification Parade and as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Bettiah Mufassil ( Banuchhapar O.P.) PS Case No. 721 / 2020.
