The petitioners apprehend arrest in a case registered for the offences punishable under section 406, 420 and other allied sections of the Indian Penal Code. The informant made allegation that the petitioners in pursuance of an agreement to sell a piece of land received rupees twelve lacs from the complainant but the petitioners did not execute the sale deed.

It is submitted that the petitioners have already returned rupees five lacs and they are ready to return the remaining amount of rupees seven lacs within two months from

Patna High Court Cr.Misc. No.28654 of 2015 (2) dt.23-07-2015 the date of receipt/production of a copy of this order. Learned counsel for the informant did not raise any objection.

Considering the facts aforesaid, if the petitioners hand over a Bank Draft of Rs.3,50,000/- within one month to the complainant, let the above named petitioners, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Ram Krishna Nagar P.S. Case no. 200 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. The petitioners shall again after one month hand over a Bank Draft of the remaining amount of Rs.3,50,000/- to the informant. If the petitioners fail to deposit the entire amount within two months, the bail bonds of the petitioners shall be cancelled.
