2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 363 and 366(A) of the Indian Penal Code, registered in connection with Ekma P.S. Case No. 348 of 2023.

3. The allegation against the petitioner along with others is of abducting the daughter of the informant.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. The victim girl has been recovered and her statement has been recorded under Section 164 of the Cr.P.C. in which she stated that she herself went out from her

Patna High Court CR. MISC. No.60378 of 2024(5) dt.11-09-2024 2/2 house as her mother was scolding her. She further stated that she has solemnized marriage with this petitioner out of her own sweet-will. Moreover, petitioner is a person of clean antecedent and he is in custody since 06.06.2023.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as no specific overt act alleged against the petitioner, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Saran at Chhapra in connection with Ekma P.S. Case No. 348 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
