The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,385 and 379/34 of the Indian Penal Code.
It is alleged that the petitioner, Sonu Kumar Singh and Ranjit Singh came with three unknown persons and demanded rupees fifty thousand as extortion from the informant and on refusal of the same, Sonu Kumar Singh assaulted on the head of the informant and thereafter the petitioner and Ranjit Singh also assaulted Arun Kumar Singh on his skull with iron rod and rupees forty thousand two hundred were taken out from the pocket of the informant.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.46531 of 2014 (2) dt.17-04-2015 2/2 that the injury has been found to be simple in nature and there is counter version of the occurrence also. It is further submitted that the informant has retracted from the initial version and has filed a petition to that effect before the learned court below. Learned counsel for the informant does not controvert the factum of compromise between the parties. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town P.S. Case No. 213 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
