JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Turkaulia P.S. Case No. 477 of 2017 for the offences punishable under Section 379 of the Indian Penal Code.
The allegation against the petitioner is that while he was engaged as a driver of the vehicle of the informant, the informant is said to have given his vehicle to the petitioner for driving and the petitioner, every day in the evening, used to park the vehicle at the darwaja of the brother of the informant. One day when the driver had not given the key of the car, the informant went to see the car at the darwaja of his brother but did not find the vehicle there, hence the suspicion that the petitioner had stolen the vehicle. The learned counsel for the petitioner submits that the petitioner has a clean antecedent and has been falsely implicated in the present case.
Patna High Court Cr.Misc. No.53205 of 2017 (2) dt.09-11-2017 2/2 Having regard to the facts and circumstances of the case, I may deem it fit and proper to enlarge the petitioner on regular bail on completion of six months of his custody from the date of his arrest i.e. 4.8.2017, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia P.S. Case No. 477 of 2017 and also subject to other terms and conditions as imposed by the learned trial court.
