The petitioners are apprehending their arrest in a case instituted under Sections 420 and 406 of the Indian Penal Code. The prosecution case, in short, is that the petitioners got filled up the forms of 282 students outside the college and deposited the forms directly to the Board by committing forgery and grabbed the entire fee amount which was to be deposited in the Bank.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent and they have been made accused due to mistake of fact. It is further submitted that

Patna High Court Cr.Misc. No.28583 of 2015 (3) dt.01-10-2015 the petitioners are jointly ready to deposit an amount of Rs.15,000/- in the court below, which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioners are named in the first information report. Considering the aforesaid facts, it is directed that the petitioners shall jointly deposit an amount of Rs.15,000/- in the court below, which shall be subject to the final disposal of the case, within a period of four weeks from today. Let the petitioners, above named, in the event of their arrest/surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Sadar P.S. Case No.118 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Sudhir Singh, J) V.P.Sinha/- U
