ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 3(i)(x)(iv) of the S.C. and S.T. Act.

Learned counsel for the petitioners submits that admittedly the occurrence took place on the private land of the petitioner which resulted in the present incident. It is further submitted that the provisions of S.C. and S.T. Act have been added only to make the charge against the petitioner grievous. It is submitted that no case under the provisions of S.C. and S.T. Act are made out as there is no use of caste name and it has not been in public view nor there are any independent witness.

Patna High Court Cr.Misc. No.4588 of 2016 (2) dt.26-04-2016 Considering the aforementioned facts and the nature of allegation made and the petitioner has no criminal antecedent, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui, in connection with S.C.S.T. P.S. Case No. 58/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
