JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1212 of 2014 for the offences instituted under Section 420 of the IPC.

Heard learned counsels for the petitioner, complainant and learned counsel for the State.

The prosecution story, in brief, is that the petitioner alluring the complainant on pretext of provide him government job in Postal Department, fraudulently taken Rs. 2,50,000/-. When the complainant enquired and verified it in Postal Department it has come to his knowledge that he has been cheated by the petitioner and the petitioner deceitfully and fraudulently grabbed his money.

Patna High Court Cr.Misc. No.29225 of 2015 (2) dt.27-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. As per allegation, it is alleged that Rs. 16,000/-and odd was paid to the petitioner through bank transaction and for rest of the amount, there is no documentary evidence to show that the said amount was paid to the petitioner. It is further submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs. 16,000/- in the court below which shall be subject to final disposal of the case. On behalf of the State and complainant it has been submitted that the petitioner is named in the complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs.

16,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1212 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
