JUSTICE MADHURESH PRASAD ORAL ORDER 26-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 147,148,149,341,342,323,386,379,504 of the Indian Penal Code, 3⁄4 of Explosive Substance Act and 17 of the CLA Act. It is submitted that the allegation is against 40-45 unknown criminals and due to his criminal antecedent the petitioner has falsely been implicated in this case by attributing his involvement on the basis of confessional statement of co-accused. The other coaccused including those who have named the petitioner have been allowed bail under various orders which is annexed as Annexure 2 series. Petitioner is in custody since 25.11.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa Nalanda in Islampur P.S. Case No. 202 of 2010 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
