The petitioner seeks bail in Town P.S. Case No. 440 of 2017 registered under Sections 341, 323, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.

Petitioner along with seven accused persons is said to have assaulted the informant and his father by means of iron rod, brickbat, etc. over row of payment of money of the sweet accorded to the accused persons.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no concern with the aforesaid occurrence. He happens to be driver of the car. Informant had hired the car for proceeding to Deoghar and has

Patna High Court Cr.Misc. No.18127 of 2018 (3) dt.17-05-2018 2/2 falsely implicated the petitioner in the case over row of payment of hired money to the petitioner. Though one injury on the head of the informant is said to be grievous in nature, but assailant of the said injury is not ascertained. Petitioner has been languishing in custody since 31.10.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Town P.S. Case No. 440 of 2017.
