The petitioner, who is languishing in custody, seeks bail in a case registered under section 395 of the Indian Penal Code and sections 25 (1-B)a, 35 of the Arms Act, is one of the named accused in this case on being apprehended with fire arms at the spot during course of commission of 'dacoity' in the house of the informant and some of his associates successfully escaped with the booty. Having regard to the facts and circumstances of the case, the petitioner appears not entitled for the privilege sought. Accordingly, his prayer for regular bail in connection with Dhibra P.S. Case No.21 of 2014, pending in the court of learned Judicial Magistrate, 1st Class, Aurangabad, is hereby refused with a direction to the Court below to proceed expeditiously.
