The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Later on charge sheet has been submitted under Sections 395, 412/34 of I.P.C. As per prosecution case, on 23.02.2023 the informant has been sent from Danapur to Gulzarbagh for railway work. When the informant with other two staff came on platform of Gulzarbagh railway station then 7 to 8 persons surrounded them and snatched the money, ornaments, mobile and other articles from them on the point of pistol and knife.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He has falsely been implicated in the present case due to village politics.

His name has been transpired in this case on the basis of confessional statement of co-accused Sanjay Sah @ Bhondua before the police, which has no evidentiary value in the eye of law. Nothing looted article or incriminating article has been recovered from the conscious possession of the petitioner. It is also submitted that petitioner is languishing in judicial custody since 03.04.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with G.R.P. Patna (Gulzarbagh) P.S. Case No. 107 / 2023 (Now S.T. No. 715/23) on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-XXIX, Patna.
