The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147/148/149/447/341/323/384/307/379/506 of the Indian Penal Code and 27 of the Arms Act.
Prosecution case is of demanding extortion from the truckers on protest being made the accused persons fired at the cleaner Ranjeet Das.
It is submitted by learned counsel for the petitioners that the informant has retracted from the initial version and has filed petitions to that effect before the learned court below, the same have been brought on record as annexures-2 and 3 to the petition. A statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.6691 of 2016 (2) dt.15-02-2016 2/2 petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Banka P.S. Case No.561/2015, pending before the learned CJM, Banka. With the above observation, this application is, accordingly, disposed off.
