JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioner is apprehending his arrest in connection with Madhepura P.S. Case No. 64 of 2013 for the offences instituted under Sections 341, 323, 324, 307/34 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant, his uncle and some other villagers came to the registry office for registration of the land. After coming out from the registry office, his villager Md. Habib @ Kailu, Md. Hafiz @ Nunu, Md. Zalil, Md. Nasir and Mehruddin were walking there then Md. Habib @ Kailu inflicted dagger blow on the informant's uncle as a result of which he sustained injury and fell down. Md. Habib @ Kailu was apprehended by the police.

Patna High Court Cr.Misc. No.29163 of 2015 (2) dt.27-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The name of the petitioner do not figure in the F.I.R. The main allegation is against Md. Habib @ Kailu for stabbing the uncle of the informant. The petitioner is a teacher in a Government School and he has been implicated in the present case due to village politics. On behalf of the State and informant it has been submitted that though the petitioner is not named in the F.I.R. but his name has come in course of investigation Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Madhepura P.S.

Case No. 64 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
