JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-02-2016 By way of the present application under section 438 of the Code of Criminal Procedure, the petitioner has renewed his prayer for bail which was earlier withdrawn after some arguments with liberty to surrender and seek bail.

Regard being had to the fact that the accused persons named in the FIR are alleged to have mercilessly beaten several police personnel on duty and damaged the police vehicle and the name of the petitioner transpired during investigation as one of the active participants, I am not inclined to grant pre-arrest bail to the petitioner.

Accordingly, the prayer for grant of anticipatory bail is rejected.
