Petitioner is an accused in a case registered for offence under sections 302/34 IPC.

Learned counsel for the petitioner submits that though the alleged death had taken place in the day, the inquest report was prepared at about 3 PM and post mortem was conducted on 4.30 PM and the FIR was lodged at 10 PM on 14.11.2017. He submits that the allegations made in the FIR do not constitute offence under section 302 IPC.

The informant has opposed the prayer for bail. He has drawn attention towards the injuries found on the body of the deceased in the post mortem report which shows multiple facture. He further submits that the informant has claimed to

Patna High Court Cr.Misc. No.16556 of 2018 (3) dt.26-04-2018 have seen the petitioner assaulting the victim. Considering the gravity of the allegation, this Court is not inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected.
